A constitution bench of the Supreme Court dismissed a plea to stop trials of civilians in military courts.

A 7-member constitution bench headed by Justice Aminuddin heard the petition related to trial of civilians in military courts.

Former Chief Justice Jawad S Khawaja’s lawyer said that the case should not be heard until the 26th constitutional amendment petitions are decided. The court asked him whether he recognizes the constitutional bench. The lawyer said that he does not accept the jurisdiction of the court.

Justice Jamal Mandukhel said that if you do not accept the jurisdiction of the court, leave the courtroom. Justice Jawad S Khawaja’s counsel said that this constitutional bench was nominated by the Judicial Commission.

Justice Jamal Mandukhel asked lawyer Hafeezullah Niazi that do you want to prosecute the case? To which he replied that I want to run this case. Justice Musrat Hilali said, think of the people who are in jails, you do not have a right to claim in this case.

Later, the Supreme Court dismissed the petition and imposed a fine of Rs 20,000 on former Chief Justice Jawad S. Khawaja.

It should be noted that Aitzaz Ahsan had filed a request not to hear the petitions against the 26th constitutional amendment.
